By requesting Prime Consultants Ltd. (“Prime Consultants” or the “Company”) to examine and/or repair the Customer’s device (“Device”) the Customer grants permission to Prime to perform any action deemed necessary in Prime’s reasonable opinion in an attempt to repair the Customer’s Device. All such work will be undertaken by Prime on a best efforts basis only. In connection with this effort, the Customer releases Prime Consultants from any liability for any data loss which may occur, or component failures occurring during attempted repair, testing, or at any other time.
Prime Consultants is not responsible for loss of profit or any direct, indirect, special, incidental, or consequential damage occurring during or after Device service.
In leaving the Device with Prime, the Customer certifies that it am the owner of the Device. In the event that the Customer is found to not be the true expressed owner of this Device, the Customer shall assume all liability for any claim made as the result of the repair rendered by Prime Consultants on this Device, including those claims which assert negligence on the part of Prime Consultants.
The Customer understands that Prime Consultants is not an authorized service dealer, and that repair rendered by Prime Consultants may void manufacturer warranties for this Device. Prime Consultants does not assume any liability or warranty in the event that the manufacturer warranties are voided.
The Customer understands that Prime Consultants offers no verbal or written warranty, either expressed or implied, regarding the success of this repair.
The Customer expressly waives all claims against Prime Consultants for any damages to this Device or data that is lost due to the repair rendered by Prime Consultants.
The Customer fully understands that as owner of the Device, it has backed up all information on all storage media contained on the Device in which it wants to preserve. The Customer also understands that Prime Consultants is not responsible for any lost data,and expressly waives any legal action against the Company. The Customer understands that all data on the Device is not the responsibility of Prime Consultants and may be lost during the repair process without the Customer’s prior knowledge.
The Customer understands that Prime Consultants is not responsible for items not claimed within 90 (Ninety) calendar days of the date listed below. The Customer also understands that Prime Consultants may recycle or sell any Device not collected after 90 (Ninety) days from the date below regardless of whether the item was repaired or not. If left after 90 (Ninety) days the Device will be considered abandoned and will become the property of Prime Consultants
The Customer understands that as a result of submitting my personal Device for repair that it could be subject to loss, theft, damage, or data loss.
ALL CLAIMS FOR LIABILITY AND/OR LOSS INCLUDING WITHOUT LIMITATION ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHICH MAY OCCUR AS A RESULT OF ANY Prime Consultants ACTION (OR INACTION) ARE HEREBY EXPRESSLY WAIVED.
Payment: The Customer understands that payment is due in full at the time of service unless specified in writing on the work order, and that charges are binding whether service is successful or not. If the Customer is unsatisfied with any of the repairs or service, the Customer must notify the technician before he/she leaves the premises. The Customer understands that Prime Consultants shall possess a lien on the Device until all work related to the examination, enhancement and repair Device work is paid for in full.
Estimated Completion Time: Prime Consultants will provide an estimated completion time for your repair/install. Please call before you come in to pick up your Device. Unforeseen circumstances may have an impact on our ability to complete the repair(s) as provided in the estimate. Most repairs take from between 1 to 5 days or longer particularly if parts/software must be ordered, and or Device was dropped and/or spillage occurred to Device prior to the Customer bringing Device to Prime Consultants. The Customer agree that Prime Consultants will be held free and harmless for Devices picked up before completion by Prime Consultants due to clients need for Device returned before completion of repair.
Liability: Any time a Device is accessed, there is risk of damage including, but not limited to, permanent loss of data or programs, and total loss of function of the Device. Prime Consultant’s liability for damage to your Device is limited only to any damage which is determined to be caused by Prime Consultants’s negligent acts or negligent omissions. Our liability for repairs is limited to the total price of the original repairs and not to exceed $250.00 (Two Hundred and Fifty dollars) in total.
Loss of Data: Data is the most important part of a Device system because it is often irreplaceable. Due to the process of repair, data may get damaged or deleted. Prime Consultants is not responsible for the loss of any data which may occur while performing work on your Device. The Customer is responsible for backing up its own data in all cases. The Customer may request that Prime Consultants back up any data at the stated price; however, we do not guarantee any backup so initiated.
Privacy: Our Technicians will not browse through your hard drive or memory cards looking at your data; however, they may inadvertently see data during the course of their work. It is the sole responsibility of the Customer to remove any personal or private files you do not want others to see.
Right to Refuse: In its sole discretion, Prime Consultants reserves the right to refuse work that it believes is beyond the scope of its ability or for other good cause.
Abandonment: If you do not pick up your equipment within 90 (Ninety) days after we notify you that the requested service is complete, we will treat your equipment as abandoned. In such case you agree to hold Prime Consultants harmless for any damage or claim for the abandoned property. Any and all charges are still your responsibility.
Warranty: Prime Consultants makes no warranty or guarantee as to the success of its attempts. We will demonstrate that the repair is complete at the time you pick up your Device. Warranty Policy is at the discretion of Prime Consultants and may change at any time without notice.
